A review into transparency in the justice system has called for reform of family court reporting to achieve greater transparency of proceedings.
Sir Andrew McFarlane argues that “creating greater transparency would create greater public confidence” and public understanding.
Judges would still be able to apply reporting restrictions, which suggests that it will be decided on a case-by-case basis, at the appointed judge’s discretion.
There must be a balance found between the public’s ability to get better access into family courts and maintaining a family’s rights to privacy within their lives, especially for vulnerable individuals.
